Two-time shooter cop Brian Pitzer found to have violated a man's civil rights.

Summary of Allegations:

Officer Brian Pitzer stopped a man for speeding and claimed the man did not provide proof of insurance for the car. Pitzer decided to tow the car. Pitzer then performed an illegal search of the car and found prescription drugs. The man’s mother had a prescription for the drugs but Pitzer charged the man with felony drug possession.

Summary of Findings:

The arrested man had a valid proof-of-insurance card in his possession. Further, a computer check reported valid insurance. “It seems that one or both of these sources would have been known to Officer P[itzer], and his causing the car to be searched was in violation.” Sustained.

The drugs discovered in the vehicle were fruit of an illegal search. Criminal charges were dismissed. However, assuming the search to be valid, only misdemeanor charges would have been appropriate, but Pitzer filed felony charges. “This over-charging activity on the part of Officer P[itzer] does not reflect well on the department.” Sustained.

Pitzer violated the arrested man’s civil rights. “Without detailing each specific constitutional violation, it is clear that Officer P[itzer] did not perform his duties under this SOP provision.” Sustained.

Also sustained was a false report charge stemming from Pitzer’s false claims of felony drug charges and lack of insurance.

No belt tape means allegations of officers using profanity were not sustained.

The IRO couldn’t decide whether Officer Pitzer lied during the IRO investigation, even though practically every statement Pitzer gave was contradicted by evidence. Not sustained.
